Whiplash and other soft-tissue-injury victims are being discriminated against by a government cap on car crash claims, a lawyer told court yesterday.

Fred Kozak, who represents two women who suffered neck and back injuries in car accidents, said the $4,000 limit for "minor injuries" is unconstitutional.

Kozak said the law is discriminatory because it limits what those with soft-tissue injuries can claim, but not those with others wounds, such as broken bones.

He told Wittmann the legislation targeted whiplash and similar injuries because the Insurance Bureau of Canada has campaigned to discredit such claimants.
